Terms of Service

1. Who we are

CarSpy ("we", "us") is a vehicle history service operated by [to be specified], registered in [to be specified] (registration number [to be specified]), address: [to be specified]. Contact: [to be specified].

These Terms of Service ("Terms") govern your use of the website https://carspy.app, your account and all paid and free services we provide (the "Service"). By creating an account or buying a subscription you agree to these Terms, our Privacy Policy, Refund Policy and Cookie Policy. If you do not agree, please do not use the Service.

2. The Service

The Service lets you look up the history of a vehicle by its Vehicle Identification Number (VIN). Depending on the market you choose (United States, South Korea or Europe) and on data availability, a report may include: vehicle specifications, odometer records, title brands (for example salvage, flood, rebuilt), accident and insurance records, auction lots with photos and sale prices, theft records, safety recalls and other information.

Free features (such as basic VIN decoding) are provided without charge and may be changed or withdrawn at any time.

3. What a report is — and what it is not

Reports are compiled automatically from licensed third-party data sources, including public registries, insurers, auctions and commercial data providers. We do not create the underlying records and cannot verify them.

  • A report reflects only the records that were available to our sources at the time it was generated. Not every accident, repair or mileage reading is reported to any database.
  • "No records found" does not mean the vehicle has no history.
  • Information may be incomplete, delayed or contain errors made by the original source.
  • A report is not a technical inspection, valuation or recommendation to buy or not to buy a vehicle.

Always combine the report with an independent inspection by a qualified mechanic and a check of the vehicle's documents before you buy. You make purchase decisions at your own discretion.

4. Your account

  • You must be at least 18 years old (or the age of majority in your country) to create an account and buy a subscription.
  • Provide a valid email address and keep your login details confidential. You are responsible for activity in your account.
  • An account is personal. Business customers may use the account for their own business purposes, but may not resell access to the account.
  • Tell us immediately at [to be specified] if you believe your account has been compromised.

5. Subscriptions and reports

Plans. Each subscription plan includes a set number of reports per monthly billing period (the "allowance"). The current plans and prices are shown on the Pricing page. One report covers one vehicle in one market (United States, South Korea or Europe).

Trial. New customers may start a trial: a set number of reports for a short period at a reduced price (currently 5 reports for 3 days for $1; the current offer is always shown on the Pricing page).

  • The trial is available only to customers who have not used a trial before — one trial per customer. We use technical measures to detect repeated trials (for example, by account, payment method and device).
  • The trial lasts the stated number of days (for example, 72 hours) from activation.
  • If you do not cancel before the trial ends, it automatically converts into a monthly subscription to the plan shown at the start of the trial, at the price shown at that time, and the first monthly payment is charged.
  • To avoid the monthly charge, cancel in your account (Subscription tab) before the trial ends.
  • Reports obtained during the trial are subject to the same rules as subscription reports.

Using reports. A report is counted against your allowance when you request it. If a report cannot be generated because our data sources fail, the report is returned to your balance automatically.

Unused allowance does not carry over to the next billing period. Extra reports bought separately do not expire while your account is active.

Access to reports. Reports you have obtained stay available in your account for as long as your account exists. You may download a PDF copy and share it with the other party of a specific vehicle transaction.

Automatic renewal. Subscriptions renew automatically every month at the price shown at the time of purchase until you cancel. We will tell you about the upcoming renewal by email in advance where required by law.

Price changes. If we change the price of your plan, we will notify you at least 14 days before the change applies. The new price applies from your next billing period; you may cancel before it starts.

Cancellation. You can cancel a trial or subscription at any time in your account: My account → Subscription → Cancel subscription, then confirm. Make sure the cancellation confirmation is shown on the screen; if it is not, send a screenshot to [to be specified]. If you cannot access your account, contact support and we will help you cancel. Cancellation takes effect at the end of the current trial or paid period; until then you keep access to your remaining reports. No further charges are made after cancellation. Payments already made are not refunded.

6. Payments

Payments are processed by our payment service provider Whop. If the provider acts as the seller of record, it charges applicable taxes (such as VAT), issues receipts and invoices, and its terms for buyers also apply to the payment. We never receive or store your full card details.

Prices are shown in US dollars. Taxes and the final amount in your local currency are shown at checkout.

7. Right of withdrawal (consumers in the EU, EEA and UK)

Consumers in the EU, EEA and UK normally have a 14-day right to withdraw from distance contracts. Reports are digital content that is not supplied on a tangible medium and is made available immediately after payment.

By starting a trial, subscription or buying extra reports, you expressly request and agree that we begin supplying the digital content immediately, before the 14-day withdrawal period expires, and you acknowledge that you thereby lose your right of withdrawal (Article 16(m) of Directive 2011/83/EU and corresponding national laws). We ask for this consent and acknowledgement at checkout and confirm it in the order confirmation email.

8. Refunds

Payments are non-refundable, except in the limited cases described in our Refund Policy (an empty report that was not returned to your balance, or a duplicate charge). Nothing in these Terms limits rights that cannot be excluded under mandatory consumer protection law.

9. Acceptable use

You agree not to:

  • access the Service with bots, scrapers or other automated means, or exceed reasonable usage;
  • resell, republish or systematically redistribute reports or report data, or use them to build a competing database;
  • attempt to bypass usage limits, open multiple accounts to obtain free or discounted access, or abuse refunds;
  • interfere with the security or operation of the Service;
  • use the Service for any unlawful purpose, including to identify or track private individuals.

We may suspend or limit access if we reasonably believe these rules have been broken.

10. Intellectual property and third-party data

The Service, its design, software and texts belong to us or our licensors. Report data and auction photos belong to their respective owners and are shown under licences held by our data suppliers. You receive a personal, non-transferable right to view and use reports for evaluating a vehicle.

11. Availability and changes

We work to keep the Service available, but it may be interrupted for maintenance or by events outside our control. Data sources may change; we may add, change or remove data types or markets. If a change materially reduces what your active paid plan includes, you may cancel your subscription before the next renewal.

12. Liability

  • We provide the Service with reasonable care and skill, but we do not guarantee that report data is complete or accurate (see section 3).
  • We are not liable for decisions you make on the basis of a report, or for indirect or consequential losses (such as lost profit, repair costs or the price paid for a vehicle).
  • Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim.
  • Nothing in these Terms excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, for fraud, or your statutory rights as a consumer.

13. Suspension and termination

You may delete your account at any time. We may suspend or close an account that breaches these Terms, is used fraudulently or remains unpaid. If we close your account without a breach on your part, we will notify you at least 30 days in advance so you can use your remaining reports, and no further charges will be made.

14. Changes to these Terms

We may update these Terms. For material changes we will notify you by email or in your account at least 14 days before they take effect. If you do not agree, you may cancel before the changes apply.

15. Governing law and disputes

These Terms are governed by the laws of [to be specified]. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence and may bring claims in its courts. Please contact us first — most issues can be solved quickly by email.

16. United States data notice

Reports for the US market may include data from the National Motor Vehicle Title Information System (NMVTIS), obtained through an approved NMVTIS data provider. NMVTIS contains title, brand and odometer information reported by states, insurers and salvage yards, but not all states or companies report all vehicles, and it does not contain detailed repair history. An NMVTIS-based report is not a substitute for an independent vehicle inspection. More information: https://vehiclehistory.bja.ojp.gov.
